Covenant Violation Procedure

Adopted by the Board of Directors 22 Jan 05

  1. Any apparent violation should be reported to a member of the POA Board or the current Chair of the Covenant Committee. The complainant must provide a written complaint accompanied by documented proof of the violation, and must agree to be available for a court appearance, if required.
     
  2. The Covenant Committee will review the complaint and respond to the complainant as to the validity of the complaint and the decision of the Committee as to the course of action to be taken.
     
  3. If the violation is determined valid and within the scope and intent of the Covenants, a certified letter will be sent requesting a written response by the offending property owner within a 20 day period. This letter will state that inadequate response will result in the matter being referred to our attorney.
     
  4. If the attorney becomes involved, his initial letter will reaffirm the Board’s intent to enforce the Covenants and outline the possibility of the property owner incurring substantial legal fees if the issue is resolved in court.
     
  5. If there is no response or an inadequate response from the property owner, the attorney will file in civil court. The court will then render a decision and order the property owner to comply. Fines and even jail time can be imposed if the property owner refuses to comply with the court order.
