Hi Michael,
I just finished reading the latest minutes re: the water system. There were a bunch of options listed re: needing additional funds for hiring more engineers and making repairs. I don't understand why additional funds are needed?? Weren't the original companies paid to give us a working system?
Weren't monies held back until the system was complete and working properly(As with all construction contracts)??
If the pumps failed because there were no screens, that is a failure of proper design. Why aren't the design companies paying for the repairs or new pumps?
Can you (or other board members) please explain why additional monies are need instead of the original contracted companies doing their job and put the answers on the web site so that all members can be informed.
If I have directed my inquires to the wrong person please, accept my apologies and forward to the correct person or committee.

Mr. Roberson:
I am taking the liberty of responding to your inquiry to Michael Hughes. The answer to most of your questions is "yes". The contract does obligate the contractor, OPEC, to deliver us an approved, working system. Some monies were held back from the contractors ( construction and pumps), and will not be resolved until the performance is satisfactory. Some of the design work was insufficiient and we are pursuing resolution of that.
I may be mistaken, but it appears that you may have missed other communications sent with Board minutes or posted on the web site over the last six months or so. They will serve to give you a better understanding of how we arrived at the current situation. As a property owner, I do not believe it should be necessary to put any additional money into the project, if we are successful in seeking remedy from the parties to the contracts and project. The discussion of additional funds that you refer to, I believe, was for temporary funding so work can proceed while we puruse compensation for the problems. We recently sought assistance form the bonding company on the project and if they intercede, no such temporary funding may be necessary.
